The human serum protein α1‐antitrypsin is the major source of antiprotease activity found in the blood. The protein is synthesised primarily by liver cells but, to a lesser extent, by at least one other cell type. Expression of the gene has provided a paradigm for studies on transcriptional regulation in liver and of tissue‐specific promoter activity. The pleiomorphic nature of the gene has given rise to a variety of α1‐antitrypsin variants some of which are clinically important. These abnormal variants may (...) be poorly synthesised, rapidly degraded or inefficiently secreted; studies on the molecular mechanisms which underly these events are providing interesting insights into the general processes of protein transport and intracellular protein degradation. Much has been written about the rights of health-care professionals to conscientiously object. Ironically, there has been no formal discussion as to whether clinical ethicists have the same right. Given that ethicists routinely deal with the same situations and questions that other health-care professionals find morally discomforting, the question as to whether they have the same right is a critical one. We conclude that ethicists should not have the same right to conscientious objection. The role of an ethicist is to (...) competently manage those situations and cases that cause moral discomfort and confusion. By conscientiously objecting, an ethicist would be failing to fulfil their primary function. The same cannot be said as forcefully about other professionals who object. Moreover, ethicists retain the right to conscientious objection to the joining of the discipline in the first place, and also retain the right to exit if they so choose. (shrink)

How the Study of Consciousness and Mapping Spiritual Experiences Can Reshape Religious Methodology This special issue of the Journal of Consciousness Studies throws down a methodological challenge to the field of Religious Studies. Over the last half century, the academic study of religion has developed a variety of angles and approaches: structuralist, Eliadian, Marxist, feminist, and so on. Recently, approaches popular in many institutions and departments have centred on linguistic and cultural analysis, notably the postmodern and deconstructivist approaches championed by (...) Derrida and others. With the dawn of the interdisciplinary field of the study of human consciousness, and with this issue of the Journal of Consciousness Studies, we challenge this prevailing approach by presenting readers with articles analysing religion, spirituality, and spiritual experience, not solely as cultural phenomena, but as phenomena that can be related to human physiology, and a kind of pan-human technology of human spiritual development. Documenting capacity assessments and identifying substitute decisionmakers in healthcare facilities is ethically required for optimal patient care. Lack of such documentation has the potential to generate confusion and contention among patients, their family members, and members of the healthcare team. An overview of our research at the Ottawa Hospital and issues that influence the consistency of documentation in the Canadian context are presented here, as well as ideas for the mitigation of these issues and ways to encourage better documentation.

This article provides a brief introduction to psychological emotion theories, particularly appraisal theory. According to appraisal theory emotions are combinations of a person’s appraisal of the novelty, valence, certainty, goal conduciveness, causal agency, controllability, and morality of a situation. These dimensions correspond to elements of the stories attorneys attempt to create in arguing a case. Appraisal theory puts specific content into the vague concept of reappraisal, accounting for emotional changes that go beyond the changes in valence and intensity generally studied (...) by law and emotions scholars. Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

Ethics consultation services provide support to staff, patients, and family members who find themselves in morally difficult situations in healthcare settings. Not unlike other clinical consultation services, ethics consultation activities should be well documented. Good documentation allows for evaluation of the consultation process and the ability to refer back to consults when needed, and provides data for future research in healthcare ethics (HCE).In our exploration of existing HCE documentation systems, we identified two main points of interest. First, HCE information documentation (...) systems are powerful tools for providing information on ethics consultation services. These documentation systems can be used to produce detailed reports on various HCE activities both institutionally and cross-institutionally. Second, our findings indicate greater agreement in the language and terminology of HCE needs to be established. Cultivation of such common language is needed in order to develop a standard healthcare ethicists can use to document and categorize consults. Standardization of language would allow data to be readily comparable and lead to more consistency in documentation of ethics consultations. Ultimately, standardization of documentation can also constitute a standard of practice for HCE in general. The development of such standards is essential for any developing profession, and will be required for HCE as it moves in towards professionalization in Canada. (shrink)

In contemporary society, humans interact with nonhuman animals in a number of ways, many of which involve the captivity of the nonhuman animals involved. Nonhuman animals trained for sport (sled dogs, horses trained for dressage, etc.), nonhuman animals confined for human entertainment (zoos, aquariums, circuses, etc.), and companion animals are all held captive by the human beings who interact with them. However, the moral acceptability of these forms of captivity seems to vary widely; this variance isn’t only a function of (...) the conditions of the captivity itself, but the reasons, attitudes, and intentions of the captors. Martha Nussbaum’s conception of species-specific flourishing allows for what she calls ‘respectful paternalism’ in the case of nonhuman animals, and in this paper, we will explore (a) Nussbaum’s account of ‘respectful paternalism’ as an aspect of justice that governs our interactions with nonhuman animals, (b) what the ‘respectful’ aspect of that paternalism involves by examining what it means for a captor to limit the autonomy of a nonhuman animal respectfully and (c) implications for our interactions with nonhuman animals in sport and entertainment environments. The past decade has produced a number of collections on women and rhetoric, women in rhetoric, and feminist approaches (...) to rhetoric. Reviewers of these collections have commended their contributions as pioneering works [End Page 298] in a new field while calling for book-length studies offering sustained appraisals of individual women figures and theoretical bases for approaching individual women and rhetorical issues, which must be approached differently if women and feminist issues are to be incorporated into the study of rhetoric. Ethos and audience, intention and identification, agonistic argumentation and collective narrative modes of argumentation--each of these takes on new shadings and nuances when women's practices are examined, and when various feminist theories are employed to assess those practices.Glenn's study is a welcome newcomer, a sustained analysis of rhetorical issues across periods, an analysis developed by spotlighting a series of women figures. Very deliberately, Glenn includes "heroic" figures such as Aspasia and Elizabeth I alongside their "lesser" sisters: the marginalized, until now unheard, and often uneducated women who developed rhetorics within severe restraints. Some may fault the selections in Glenn's study, and the inevitable omissions, and some may object that focusing on women's silence is yet another victim narrative. Careful readers, however, will find that the discussion of silence in women's rhetoric deftly reverses the traditional negative connotations: "Silence is perhaps the most undervalued and under-understood traditionally feminine rhetorical site" (175). Silence need not be read simply as "passivity. Silence may take many forms and serve many functions" (176), including "enlightened presence" (177).In "Cartographies of Silence" (The Dream of the Common Language, New York: Norton, 1978), Adrienne Rich writes, Silence can be a plan rigorously executed the blueprint to a life Do not confuse it with any kind of absence. (17) Rhetoric Retold begins and concludes by "mapping the silences" of women's presence in the history of rhetoric, and in the very conception of rhetoric. Like Rich, Glenn defines the subtle complexities of silence and absence: silence can indeed be a plan, rigorously executed. We should not confuse it with any kind of absence. Until recently, most histories of rhetoric have not given much attention to women as individual figures or as practitioners [End Page 299] of distinct rhetorical genres. Quite to the contrary, many histories have simply asserted, without proof or evidence, that women have always been forbidden to study or practice rhetoric. Strong assertions of absence belie the truth intimated by Democritus's rebuke: "A woman must not practice argument. This is dreadful. The Catholic Universtiy of America Washington, D.C. MARK D. NAPACK Hans Urs von Balthasar. His Life and Work. Edited by DAVID L. SCHINDLER. San Francisco: Communio Books/Ignatius Press, 1991. Pp. 305. This is an important contribution to English-language scholarship on the Swiss theologian Hans Urs von Balthasar. As such it marks a nice complement to the volume edited by John Riches, The Analogy of Beauty: The Theology of Hans Urs von Balthasar (Edinburgh: T. & T. Clark, 1986). Schindler's volume is a slightly edited translation of Hans Urs von Balthasar: Gestalt und Werke, edited by Karl Lehmann and Walter Kasper (Cologne: Communio, 1989). Most of the articles appeared in one or more of the many editions of Communio International Catholic Review, the periodical founded by Balthasar. The richness of the volume lies not only in the quality of individual selections but in the range of material that is covered. Many areas of Balthasar's life and work have remained little known, especially in the English-speaking world, until the appearance of this volume. The pur- 690 BOOK REVIEWS pose of the book, according to Schindler's preface, is "to help display [Balthasar's] vision and the character and range of his service to the Church and to culture" (p. xiii). There are several essays in the volume which shed new light on Balthasar's life, as well as on his philosophical position. Peter Henrici's lengthy biographical sketch is the most complete such contribution available until now, even though he calls it "preliminary and inadequate " (p. 7). It is extremely useful, in conjunction with Balthasar's own autobiographical statements, to situate the written work in the context of a large mission in the Church. It is also helpful in clarifying the relationship between Balthasar and the Jesuit order: his entry into the Society of Jesus, his studies, his departure from the Jesuits, and the attempted reconciliation with them shortly before his death. The extent of his health problems, also, only underlines the value of his literary production. Many details concerning the meeting with Adrienne von Speyr and the founding of the secular institute ]ohannesgemeinschaft are also provided. Throughout these activities and the writings that surround them, "the issue is the Church in the world, not a radiating of the Church's holiness into the profane world, but the leavening of the world from within in order to make visible God's glory which still shines in this world" (p. 24). Henrici has another essay in the collection on the philosophy of Balthasar. This is a little explored area of Balthasar's writings and Henrici's contribution is especially valuable. By clarifying Balthasar's position in relation to key figures in the history of philosophy, it provides many significant hints to facilitate the integration of Balthasar's theology within the academic milieu. Hausdorff's paradoxical decomposition of a sphere with countably many points removed actually produced a partition of this set into three pieces A,B,C such that A is congruent to B, B is congruent to C, and A is congruent to B ∪ C. While refining the Banach–Tarski paradox, R. Robinson characterized the systems of congruences like this which could be realized by partitions of the sphere with rotations witnessing the congruences: the only nontrivial restriction is that the system should not require (...) any set to be congruent to its complement. Later, J. F. Adams showed that this restriction can be removed if one allows arbitrary isometries of the sphere to witness the congruences. The purpose of this paper is to characterize those systems of congruences which can be satisfied by partitions of the sphere or related spaces into sets with the property of Baire. A paper of Dougherty and Foreman gives a proof that the Banach–Tarski paradox can be achieved using such sets, and gives versions of this result using open sets and related results about partitions of spaces into congruent sets. The same method is used here; it turns out that only one additional restriction on a system of congruences is needed to make it solvable using subsets of the sphere with the property of Baire with free rotations witnessing the congruences. Actually, the result applies to any complete metric space acted on in a sufficiently free way by a free group of homeomorphisms. God and the City, based on the Aquinas Lecture delivered at the University of Dallas in 2022, aims to think about politics ontologically. In other words, it seeks to reflect on, not some political theory or other, nor on the legitimacy of political action or the distinctiveness of particular regimes, but on the nature of political order as such, and how this order implicates the fundamental questions of existence, those concerning man, being, and God. Chapter one of this book argues that, just as metaphysics, in studying being as a whole, cannot but address the question of God in some respect, so too does politics, the ordering of human life as a whole, necessarily implicate the existence of God. In this regard, the modern liberal project has deluded itself in attempting to render religion a private, rather than a genuinely political, matter. We cannot organize human existence without making some claim, whether implicitly or explicitly, about the nature of God and God's relation to the world. The second chapter approaches this theme from the anthropological dimension. As Plato affirmed, the "city is the soul writ large": if man is religious by nature, he cannot be properly understood, and the human good cannot be properly secured and fostered, if the "God question" is "bracketed out" of the properly political order. Moreover, if we fail to recognize the essentially political dimension of relation to God, we will be unable properly to grasp the presence of God in the (ecclesial and sacramental) Body of Christ: God cannot be real in the Church as Church unless he is also real in the city as city (and vice versa). In his De regno, Aquinas famously affirms that "the king is to be in the kingdom what the soul is in the body and what God is in the world." Chapter three offers a careful study of the body-soul relationship in order to illuminate, on the one hand, the nature of political authority, and, on the other, the precise way that God is present in human community. We prove two general results about the preservation of extendible and $C^{(n)}$ -extendible cardinals under a wide class of forcing iterations (Theorems 5.4 and 7.5). As applications we give new proofs of the preservation of Vopěnka’s Principle and $C^{(n)}$ -extendible cardinals under Jensen’s iteration for forcing the GCH [17], previously obtained in [8, 27], respectively. We prove that $C^{(n)}$ -extendible cardinals are preserved by forcing with standard Easton-support iterations for any possible $\Delta _2$ -definable behaviour of the power-set function on (...) regular cardinals. We show that one can force proper class-many disagreements between the universe and HOD with respect to the calculation of successors of regular cardinals, while preserving $C^{(n)}$ -extendible cardinals. We also show, assuming the GCH, that the class forcing iteration of Cummings–Foreman–Magidor for forcing $\diamondsuit _{\kappa ^+}^+$ at every $\kappa $ [10] preserves $C^{(n)}$ -extendible cardinals. We give an optimal result on the consistency of weak square principles and $C^{(n)}$ -extendible cardinals. In the last section prove another preservation result for $C^{(n)}$ -extendible cardinals under very general (not necessarily definable or weakly homogeneous) class forcing iterations. As applications we prove the consistency of $C^{(n)}$ -extendible cardinals with $\mathrm {{V}}=\mathrm {{HOD}}$, and also with $\mathrm {GA}$ (the Ground Axiom) plus $\mathrm {V}\neq \mathrm {HOD}$, the latter being a strengthening of a result from [14]. On 6 September 1966, the prime minister of South Africa, Dr HF Verwoerd was killed by Mr Tsafendas, a Portuguese national of Greek descent, in parliament by stabbing him in the chest. Mr Tsafendas was a messenger in parliament. At the enquiry trial of Mr Tsafendas, he was found unfit to stand trial on the ground that he suffered from schizophrenia. The psychiatric evidence during the enquiry trial was reviewed and discussed under the following headings: Diagnosis of schizophrenia; Consideration of (...) cultural factors in forensic psychiatric settings; Delusional infestation v. extreme overvalued beliefs; Simulation of psychosis; Ethical considerations in criminal capacity and trial competency assessments. Lessons from the Mr Tsafendas enquiry trial for forensic psychiatrists where a defendant previously diagnosed with schizophrenia commits a prominent political murder, are summarised. It is emphasised that the personhood of an accused referred for forensic observation should be respected and protected, instead of focusing exclusively on a specific diagnosis. (shrink)

Decency remains one of the most prevalent yet least understood terms in today's political discourse. In evoking respect, kindness, courage, integrity, reason, and tolerance, it has long expressed an unquestioned duty and belief in promoting and protecting the dignity of all persons. Today this unquestioned belief is in crisis. Tribalism and identity politics have both hindered and threatened its moral stability and efficacy. Still, many continue to undertheorize its political character by isolating it from the effects of identity politics. Decency (...) and Difference argues that decency is a primary source of the political tension that has long shaped the struggles for power, identity, and justice in the global arena. It distinguishes among basic, conservative, and liberal strands of decency to critically examine the many conflicting and competing applications of decency in global politics. Together these different stands reflect a long and uneven evolution from the British and American Empire to a global network of justice. By engaging the contradictions of the progressive and retrogressive qualities of decency and the role played by emotion and affect in driving these contradictions, the book exposes the propriety gaps of decency and the disparate ways that it is practiced in global politics. The book thus addresses the global challenge of reconciling different political proprieties and configuring a diverse political ethic of decency. (shrink)

Sport categorization is often justified by benefits such as increased fairness or inclusion. Taking inspiration from John Rawls, Sigmund Loland’s fair equality of opportunity principle in sport (FEOPs) is a tool for determining whether the existence of an inequality ethically justifies the institution of a new category in any given sport. It is an elegant ethical normative framework, but since FEOPs does not account explicitly for athlete safety (i.e. athlete physical and mental wellbeing), we are left in an ethically dubious (...) situation where the risk of harm associated with a categorization regime might in fact prove to be greater than the risk of harm present within the sport before its introduction. To address this critical gap, I propose the ‘scales of ignorance’ ethical normative framework to weigh the relative risk of harm within a sport, crucially inserting athlete safety into the discourse surrounding ethical justification for categorization in sport. The current paper is the first explicit formulation of assessment and ethical justification of risk of harm in the familiar logic of FEOPs. The scales of ignorance framework can also be used independently of Loland’s approach. Two new concepts are also proposed: ‘insidious risk of harm’ and ‘pernicious risk of harm’. (shrink)

The body of Christ is the focus of a range of questions posed to St. Thomas Aquinas by the audiences at the quodlibetal disputations over which he presided at the University of Paris. These questions arise from reflection on the Catholic faith, which holds that the body of Christ is given to us as spiritual food in the sacrament of the altar, the Eucharist. In response to questions about the Eucharist, Aquinas tries to explain how Christ’s body could come to (...) be present in the sacrament by the bread becoming Christ’s body, arguing that by God’s power the substance of Christ’s body can come to be present under the attributes of bread, which can continue to exist without being the attributes of anything. Yet why must this be the answer? Why can’t Christ’s body come to be present with the bread, for instance? Aquinas insists that the bread and Christ’s body never exist together, but he allows that Christ’s glorified body can be with another body in the same place. So, why not in the Eucharist? Or why can’t Christ assume the bread, as he assumed a human nature, thereby making it his body? It might seem unfitting for Christ to have such a non-rational nature, yet that is exactly what Aquinas thinks happened while Christ’s body lay in the tomb. So, why not in the Eucharist? This paper attempts to explain why not. Examining the full range of questions posed to Aquinas about the body of Christ reveals a number of principles that together seem to imply that nothing less than the full transubstantiation of bread into Christ’s body is possible if Christ’s body is to become really present in the Eucharist. “Respirators, not furnished” is a phrase that appears in Muriel Rukeyser’s poetic sequence The Book of the Dead, addressed to the catastrophic silicosis epidemic that afflicted miners of the Hawk’s Nest Tunnel. Using the example of Rukeyser’s text, which I taught as part of a course on extractionism during the early months of the pandemic and again in its aftermath, the essay asks what it means to read on the precipice of disaster and what disasters of reading are threatened by (...) our current moment. Ethics support staff help others to deal with moral challenges. However, they themselves can also experience moral challenges such as issues regarding (breaching) confidentiality when practicing ethics support. Currently there is no insight in these confidentiality issues and also no professional guidance for dealing with them. To gain insight into moral challenges related to Moral Case Deliberation (MCD), we studied a) beliefs and experiences of MCD facilitators regarding breaching confidentiality, b) considerations for (not) breaching confidentiality, and c) needs for an (...) ethics support tool. Data collection consisted of qualitative research methods: six semi-structured interviews; analyses of a) two recorded MCD sessions, and b) a focus group with MCD facilitators. Findings: MCD facilitators mention different conceptions and interpretations of confidentiality and various moral challenges. Questions concerning confidentiality ultimately cause reflections on roles and responsibilities of facilitators. Needs for ethics support vary from seeking advice to procedural and sometimes normative guidance for MCD facilitators. Education for MCD facilitators should focus on developing a concrete tool that stimulates awareness and reflection(skills). (shrink)

Purpose/methods: This study investigated the relationship between ethics education and training, and the use and usefulness of ethics resources, confidence in moral decisions, and moral action/activism through a survey of practicing nurses and social workers from four United States (US) census regions. Findings: The sample (n = 1215) was primarily Caucasian (83%), female (85%), well educated (57% with a master's degree). no ethics education at all was reported by 14% of study participants (8% of social workers had no ethics education, (...) versus 23% of nurses), and only 57% of participants had ethics education in their professional educational program. Those with both professional ethics education and in-service or continuing education were more confident in their moral judgments and more likely to use ethics resources and to take moral action. Social workers had more overall education, more ethics education, and higher confidence and moral action scores, and were more likely to use ethics resources than nurses. Conclusion: Ethics education has a significant positive influence on moral confidence, moral action, and use of ethics resources by nurses and social workers. (shrink)

Philosophers have developed three theories of luck: the probability theory, the modal theory, and the control theory. To help assess these theories, we conducted an empirical investigation of luck attributions. We created eight putative luck scenarios and framed each in either a positive or a negative light. Furthermore, we placed the critical luck event at the beginning, middle, or end of the scenario to see if the location of the event influenced luck attributions. We found that attributions of luckiness were (...) significantly influenced by the framing of the scenario and by the location of the critical event. Positively framing an event led to significantly higher lucky ratings than negatively framing the same exact event. And the closer a negative event was placed toward the end of a scenario, the more unlucky the event was rated. Overall, our results raise the possibility that there is no such thing as luck and thereby pose serious challenges to the three prominent theories of luck. We instead propose that luck may be a cognitive illusion, a mere narrative device used to frame stories of success or failure. (shrink)
